This Agreement applies between you, the User of this Website, and Aleph Educators, the owner and provider of this Website. Your agreement to comply with and be bound by these Terms and Conditions is deemed to occur upon your first use of the Website. If you do not agree to be bound by these Terms and Conditions, you should stop using the Website immediately.

1. Definitions and Interpretation

• “Account”: Means collectively the personal information, Payment Information, and credentials used by Users to access Paid Content.

• “Services”: Means the educational services available to you through this Website, specifically use of the Aleph Educators proprietary e-learning platform.
• “Student”: Means any minor (typically aged 10–15) utilizing the platform under the supervision of a Parent or Teacher.
• “User” / “Users”: Means any third party (Parent or Teacher) that accesses the Website and is not employed by Aleph Educators.

2. Age Restrictions and Parental Responsibility

• 2.1 Persons under the age of 18 (“Students”) should use this Website only with the supervision of an Adult (Parent or Teacher).
• 2.2 Payment Information must be provided by or with the permission of an Adult.
• 2.3 Parents and Teachers are responsible for monitoring their Student’s usage and ensuring the Student adheres to the rules of conduct set out in Section 6.

3. Intellectual Property

• 3.1 All Content included on the Website, including, but not limited to, text, graphics, logos, icons, images, data compilations, page layout, underlying code and software is the property of Aleph Educators.
• 3.2 You may not reproduce, copy, distribute, store or in any other fashion re-use material from the Website unless given Our express written permission to do so.

4. Educational Disclaimer (No Guarantees)

• 4.1 The Content of this Website is intended solely for educational purposes. We make no warranty or representation that the Website will meet your specific academic requirements.
• 4.2 No Professional-Client Relationship: While your membership creates a contractual relationship for the delivery of digital services, it does not constitute a private tutoring, psychological, or legal advisory relationship.
• 4.3 No Guarantee of Results: Aleph Educators makes no guarantee of any specific results (e.g., SEA or CSEC grades/placements) from the use of our Services. A Student’s success depends on individual effort and external factors beyond our control.

5. Accounts and Security

• 5.1 You represent and warrant that all information you submit is accurate and truthful.
• 5.2 It is recommended that you do not share your Account details. We accept no liability for any losses or damages incurred as a result of your Account details being shared by you.
• 5.3 If you have reason to believe that your Account details have been obtained by another person without consent, you should contact Us immediately at [email protected].

6. Use of Communications Facilities

When using any system on the Website, you must not use obscene or vulgar language or submit Content that is unlawful, abusive, threatening, harassing, or defamatory. Failure to comply may result in immediate account termination.

7. Services, Pricing and Availability

• 7.1 All pricing information on the Website is correct at the time of going online. We reserve the right to change prices as necessary.
• 7.2 No part of this Website constitutes a contractual offer capable of acceptance. Your order constitutes a contractual offer that We may, at Our sole discretion, accept.

8. Payments and No Refund Policy

• 8.1 Payment for Services shall be taken via your chosen method (Paywise Card, Paywise Cash/Linx Agent, or Bank Transfer). For all payments, access will be granted only once the transaction is verified by our administration team.

• 2 Manual Verification Requirement: The User is responsible for immediately providing a clear copy of the Paywise Agent receipt, or bank transfer receipt to [email protected]. Failure to provide proof of payment will result in delays in account activation.

• 8.3 No Refunds: All payments for access to Aleph Educators are non-refundable. Due to the digital nature of our services, access to educational content, worksheets, and resources is granted immediately upon account activation. As such, the “product” is considered consumed and utilized the moment access is provided. Users understand and agree that refunds will not be issued for any reason, including technical issues, dissatisfaction with content, or non-use of the platform by the Student or User.

9. Termination and Cancellation

Either Aleph Educators or you may terminate your Account. If We terminate your Account, you will be notified by email. We reserve the right to terminate without giving reasons if a breach of these terms is suspected.

10. Privacy and Data Protection

Use of the Website is also governed by our Privacy Policy, which is incorporated into these Terms and Conditions by this reference. Aleph Educators acts as both a Data Controller and a Data Processor in accordance with the T&T Data Protection Act, 2011.

11. Limitation of Liability

• 11.1 To the maximum extent permitted by the laws of Trinidad and Tobago, We accept no liability for any direct or indirect loss or damage, foreseeable or otherwise, arising from the use of the Website or any information contained therein.
• 11.2 We accept no liability for any disruption or non-availability of the Website resulting from external causes including, but not limited to, Bluehost equipment failure, ISP failure, or natural events.

12. Law and Jurisdiction

These Terms and Conditions and the relationship between you and Aleph Educators shall be governed by and construed in accordance with the Law of Trinidad and Tobago, and you agree to submit to the exclusive jurisdiction of the courts of Trinidad and Tobago.
